In trade secret litigation, the parties and their experts are often direct competitors. Clients need to protect the secrecy of their information, but that same information is the very subject of the dispute. Negotiating and enforcing an appropriate protective order is therefore of utmost importance in trade secret litigation. This program will feature three prominent commercial litigation attorneys from Boston to discuss their experiences in negotiating, enforcing, and working with protective orders in trade secret litigation. The panel will cover the life of a protective order through negotiation and drafting, court approval, discovery, filings under seal, and the use of protected material at trial.
