What does legalization of recreational marijuana mean for Massachusetts employers and employees? On December 15, 2016, the Regulation and Taxation of Marijuana Act began to take effect. Under the new law, adults 21 years of age or older may possess and use recreation marijuana. The Act provides limited guidance on how to balance employers' rights to restrict their employees' marijuana use and employees' rights under the new law.
